HMD OffGrid Unlimited Plan Terms and Conditions (Unlimited Plan Terms”)

The HMD OffGrid Unlimited Plan ("Unlimited Plan") is made available by RCD 2023 Limited of 2 Scala Street, London, England, W1T 2HN ("We", "Us", "Our" or "RCD"). RCD is the creator and operator of the HMD OffGrid service and app. The App has been developed together by Us and the manufacturer of HMD OffGrid device, HMD Global Oy.

The Unlimited Plan is made available subject to the HMD OffGrid service and HMD OffGrid app Terms of Use ("HMD OffGrid Terms of Use"). These Unlimited Plan Terms should be read in conjunction with the HMD Offgrid Terms of Use. If there are any conflicts between these Unlimited Plan Terms and the HMD Offgrid Terms of Use, the HMD Offgrid Terms of Use shall prevail.

1. What is included in the Plan?

a. Unlimited data allowance allowing you to send and receive text-based messages via the satellite network on the HMD OffGrid app when you do not have a cellular or internet connection.

b. Ability to use the unlimited data allowance to send and receive text-based messages via the satellite network on the HMD OffGrid app anywhere there is access to the HMD OffGrid service (see https://www.hmd.com/hmd-offgrid-coverage for coverage).

c. Access to the 24/7 SOS assistance feature as described in the HMD OffGrid Terms of Use.

2. Fair Use Policy

This Plan is subject to a fair use policy to ensure all users have equitable access to the service. Excessive or unreasonable use of messaging data, which may negatively impact the service experience of other users, could result in us taking action, including temporarily suspending your data allowance or terminating the plan.

3. How long is my contract and how does it renew?

a. When you sign up for the monthly payment plan, you are committing to a minimum contract length of 12 months, beginning on the date you confirm your acceptance of the Unlimited Plan Terms by submitting valid payment details that are accepted by RCD (“Minimum Term”).

b. At the end of the Minimum Term, your subscription to the Unlimited Plan will automatically renew for recurring one calendar year period (each a “Renewal Period”) at the then advertised standard full cost for the Annual Plan.

c. You can disable automatic renewals via your Account. This means that your subscription to the Annual Plan will lapse at the end of your Minimum Term or Renewal Period and you will no longer have access to the services under the Annual Plan.

d. You must give us notice of cancellation before the end of the Minimum Term or any Renewal Period if you do not want your subscription to the Annual Plan to automatically renew.

4. What rights do I have to cancel?

a. If you are a UK or EU/EAA consumer, you have a legal right to change your mind. You have 14 days from the date of confirmation to your subscription to the Annual Plan to change your mind about your purchase (“Cooling Off Period”), but you lose the right to cancel your purchase of any digital product when you start to download or stream it.

b. If you do not live in the UK or EU/EAA (or any other country where rights to cancel are protected), and/or you are outside of the Cooling Off Period, then if you cancel your subscription to the Annual Plan before the expiry of the Minimum Term, you lose access to your data allowance and other services.

5. How do I pay and can fees increase?

a. You will need a current, valid, payment card that is acceptable to RCD in order to complete the process of subscribing to the Plan.

b. All subscription fees are payable in advance for your recurring billing period and will be taken from your payment card no more than five days before the start of your next billing period.

c. We may increase fees for the Plan in accordance with the HMD OffGrid Terms of Use.
