HMD OffGrid Freedom Plan Terms and Conditions (Freedom Plan Terms”)

The HMD OffGrid Freedom Plan ("Freedom Plan") is made available by RCD 2023 Limited of 2 Scala Street, London, England, W1T 2HN ("We", "Us", "Our" or "RCD"). RCD is the creator and operator of the HMD OffGrid service and app. The App has been developed together by Us and the manufacturer of HMD OffGrid device, HMD Global Oy.

The Freedom Plan is made available subject to the HMD OffGrid service and HMD OffGrid app Terms of Use ("HMD OffGrid Terms of Use"). These Freedom Plan Terms should be read in conjunction with the HMD Offgrid Terms of Use. If there are any conflicts between these Freedom Plan Terms and the HMD OffGrid Terms of Use, the HMD OffGrid Terms of Use shall prevail.

1. What is included in the Freedom Plan?

a. A data allowance as advertised allowing you to send and receive text-based messages via the satellite network on the HMD OffGrid app when you do not have a cellular or internet connection.

b. Ability to use your data allowance to send and receive text-based messages via the satellite network on the HMD OffGrid app anywhere there is access to the HMD OffGrid service (see https://www.hmd.com/hmd-offgrid-coverage for coverage).

c. Access to the 24/7 SOS assistance feature as described in the HMD OffGrid Terms of Use.

2. What are the rules around my data usage?

a. The Freedom Plan grants you a bulk data allowance which you are free to use at any time within a one-year period, beginning on the date you confirm your acceptance of the Freedom Plan Terms by submitting valid payment details that are accepted by RCD (“the Usage Term”).

b. At the end of the Usage Term, and any subsequent Renewal Period as defined below, we will refresh your Freedom Plan and you will be charged a prepayment amount for a new bulk data allowance to be used over the subsequent one year period (a “Renewal Period”) at the then advertised standard full cost for the Freedom Plan.

c. You can disable the automatic refresh of the Freedom Plan only by scheduling a cancellation of the service via your Account. You are free to use the remaining data alowance, and that access to the services under the Freedom Plan will cease at the end of the then current Usage Term or Renewal Period.

d. You must give us notice of cancellation before the start of a Renewal Period if you do not want your data allowance to be refreshed for that Renewal Period.

3. What rights do I have to cancel?

a. If you are a UK or EU/EAA consumer, you have a legal right to change your mind. You have 14 days from the date of confirmation to your subscription to the Annual Plan to change your mind about your purchase (“Cooling Off Period”), but you lose the right to cancel your purchase of any digital product when you start to download or stream it.

b. If you do not live in the UK or EU/EAA (or any other country where rights to cancel are protected), and/or you are outside of the Cooling Off Period, then if you cancel your subscription to the Annual Plan before the expiry of the Minimum Term, you lose access to your data allowance and other services.

4. How do I use my data allowance, and what happen if I run out?

a. Where the Freedom Plan is advertised as providing “up to” a certain number of messages, this assumes a typical message length of 35 characters. A longer message will contain more data, and will therefore consume more of your data allowance, meaning your allowance may not provide the advertised number of messages.

b. Messages sent and received over the satellite connection will consume your data allowance.

c. Messages sent as part of the SOS feature do not consume your data allowance.

d. If you do not use your data allowance within the Usage Term, your data allowance will expire. No credit will be provided for unused data allowance that you may have at the end of the Usage Term or any Renewal Period.

e. When your data allowance is used up, the data quota will be automatically topped up at the then advertised standard full cost for the Freedom Plan. However, the plan expiry date will remain unchanged. If you disable the automatic refresh of the Freedom Plan by scheduling a cancellation of your service via your Account then data allowance would not be automatically topped up.

5. How do I pay and can fees increase?

a. You will need a current, valid, payment card that is acceptable to RCD in order to complete the process of subscribing to the Freedom Plan.

b. All subscription fees are payable in advance.

c. We may increase fees for the Freedom Plan in accordance with the HMD OffGrid Terms of Use.
