HMD OffGrid Add On Services Terms and Conditions ("Add On Terms")

The HMD OffGrid Add On Services ("Add On Services") are made available by RCD 2023 Limited of 2 Scala Street, London, England, W1T 2HN ("We", "Us", "Our" or "RCD"). RCD is the creator and operator of the HMD OffGrid service and app. The App has been developed together by Us and the manufacturer of HMD OffGrid device, HMD Global Oy.

The Add On Services are made available subject to the HMD OffGrid service and HMD OffGrid app Terms of Use ("HMD OffGrid Terms of Use"). These Add On Terms should be read in conjunction with the HMD Offgrid Terms of Use. If there are any conflicts between these Add On Terms and the HMD OffGrid Terms of Use, the HMD OffGrid Terms of Use shall prevail.

1. What are Add On Services?

a. Add On Services are optional features that can be purchased in addition to your existing HMD OffGrid subscription plan.

b. Currently, the only Add On Service available is the Tracking Service, as described in the HMD OffGrid Terms of Use and further detailed in these Add On Terms.

2. What is included in the Tracking Service Add On?

a. Unlimited use of the Tracking Service feature, allowing you to send GPS location pins to pre-selected contacts at customizable frequencies for customizable tracking session durations.

b. Ability to use the Tracking Service anywhere there is access to the HMD OffGrid service (see https://www.hmd.com/hmd-offgrid-coverage for coverage).

3. How the Tracking Service Works

a. Contact Configuration: You may configure and manage your tracking contacts through your Account when you have internet connectivity.

b. Contact Notification: Upon starting a tracking session, your selected tracking contacts will receive an SMS or email notification, based on your chosen method, containing a unique tracking link.

c. Your tracking contacts can view your location through their unique tracking link in the web portal for the duration of the tracking session

d. You acknowledge and accept that by using the Tracking Service, you are explicitly consenting to share your location information with your selected tracking contacts for the duration specified in your tracking session.

4. Fair Use Policy

The Add On Services are subject to a fair use policy to ensure all users have equitable access to the service. Excessive or unreasonable use of the Add On Services, which may negatively impact the service experience of other users, could result in us taking action, including temporarily suspending your access to the Add On Services or terminating your subscription.

5. Subscription Term and Cancellation

a. Add On Services are provided on a monthly subscription basis, with no minimum commitment period.

b. Your subscription to Add On Services will automatically renew each month until cancelled.

c. If you are a UK or EU/EAA consumer, you have a legal right to change your mind. You have 14 days from the date of confirmation to your subscription to the Add-on Plan to change your mind about your purchase (“Cooling Off Period”), but you lose the right to cancel your purchase of any digital product when you start to download or stream it.

d. If you do not live in the UK or EU/EAA (or any other country where rights to cancel are protected), and/or you are outside of the Cooling Off Period, then if you cancel your subscription to the Add-on Plan before the expiry of the Minimum Term, you lose access your right to cancel.

e. You may cancel your Add On Services at any time through your Account. Cancellation will take effect at the end of your current billing period.

6. Payment Terms

a. You will need a current, valid payment card that is acceptable to RCD in order to subscribe to Add On Services.

b. All subscription fees for Add On Services are payable in advance for your recurring monthly billing period and will be taken from your payment card no more than five days before the start of your next billing period.

c. We may increase fees for Add On Services in accordance with the HMD OffGrid Terms of Use.

7. Eligibility

a. You must have an active HMD OffGrid subscription plan to purchase and maintain Add On Services.

b. If your primary subscription plan is terminated, suspended or cancelled for any reason, your Add On Services will automatically terminate at the same time.

8. Changes to Add On Services

a. We may modify, add to, or remove from the Add On Services offered from time to time.

b. We will notify you of any material changes to your Add On Services at least 30 days before such changes take effect.

c. If you do not accept any material changes to your Add On Services, you may cancel your subscription to the affected Add On Service without penalty by contacting us on the details set out in the HMD OffGrid Terms of Use.
